区块链技术下公共借阅权困境的破解之道

摘　　要：公共借阅权是一种平衡公共图书馆免费借阅导致作者利益受损而给付补偿金的权利,但是公共借阅权的构建和实施存在利益层面上多方分配不均,如法律层面上与权利穷竭原则冲突,实施层面上图书馆信息服务有待提高的困境。区块链技术以其去中心化、智能合约、透明度等优势可以针对性地破解公共借阅权的困境,利用区块链技术构建多中心化图书馆分布模式、公共借阅体系架构和“三位一体”公共借阅合约可以逐个破解公共借阅权实施中的困境,构建符合我国国情的公共借阅权。Public lending right is a right to compensate authors for their losses caused by the free borrowing of public libraries.However,the construction and implementation of the public lending right has the dilemma of uneven distribution of multi-party interests at the level of interest,conflicts with the principle of exhaustion of rights at the legal level,and the need to improve library information services at the implementation level.Blockchain technology,with its advantages of decentralization,smart contracts,and transparency,can solve the dilemma of public lending rights in a targeted manner.By using blockchain technology to build a multi-centralized library distribution model,public lending system architecture,and a“three-in-one”public lending contract can solve the difficulties in the implementation of public lending rights one by one,constructed the public lending right that conforms to our country's national conditions.
