投资便利化框架下“争端前机制”的发展进路及中国参与

摘　　要：在投资者—东道国争端解决机制(ISDS机制)面临正当性危机的背景下,侧重于“争端发生后”阶段的争端解决面临诸多困境,ISDS机制改革进程陷入瓶颈。与之不同,以可持续发展为内涵的投资便利化议题的兴起,为投资争端的处理提供了崭新思路。投资便利化试图通过“争端发生前”阶段的投资争端预防,构建起一套“争端前机制”,不仅运用一系列投资政策、投资工具以及投资程序的制定与优化,加强对于东道国规制及服务投资的能力建设,而且通过构建投资争端预防机制,处理投资者意见及申诉,以减少潜在的投资争端。中国应当顺时而动,在ISDS机制改革受阻的当下,将投资争端处理思路从“争端后”转向“争端前”,通过投资便利化下的能力建设与预防机制构建,以更为平衡的方式妥善处理与外商投资的互动关系。In the context of the crisis of legitimacy of the investor-state dispute settlement mechanism(ISDS mechanism),the dispute settlement focusing on the“post-dispute”stage faces many difficulties,and the reform process of the ISDS mechanism is stuck in a bottleneck.In contrast,the investment facilitation issues follow the connotation of sustainable development,providing a new way of thinking for the dispute settlement.Investment facilitation tries to build a set of“pre-dispute mechanism”through the“pre-dispute”stage of investment dispute prevention.It not only uses a series of investment policies,investment tools and investment processes to strengthen capacity building of investment regulations and services for host countries,but also by building an investment dispute preventive mechanism to deal with investors’opinions and complaints to reduce potential investment disputes.At the moment when the reform of the ISDS mechanism is hindered,China should follow the trend,shift the idea of handling investment disputes from“post-dispute”to“pre-dispute”,and establish a more balanced relationship between government and foreign investorsthrough capacity building and preventive mechanism construction under investment facilitation.
