摘 要:环境规制失灵是长期困扰我国环境治理的“顽疾”。文章基于政治经济学逻辑,深入剖析环境规制利益相关方相互关系的实质,揭示了我国在环境规制方面长期存在规制失灵现象的根源。同时,结合我国现阶段在环境规制方面的实践,针对地方政府、污染企业和公众相互之间的关系提出相应矫正措施。这些矫正措施正是构建以政府为主导、企业为主体、社会组织和公众共同参与的生态环境治理体系的制度基础。Environmental regulation failure has been a kind of“chronic disease”bothering the environmen-tal governance in China for a long period of time.Based on the logic of political economics,this paper makes an in-depth analysis of the essence of the relatioanships between the stakeholders of environmental regulation,and reveals the root cause of environmental regulation failure existing for a long period of time in China.Simultaneously,com-bined with the present practice in environmental regulation in China,this study puts forward corresponding correc-tive measures targeting the relationships between the local government,polluting enterprises and the public.These corrective measures are just the institutional base for building an ecological environment governance system with the government as the leader,enterprises as the main body,and co-participation by social organizations and the pub-lic.
