摘　　要：目前,全国绝大多数地区已经制定中医药地方条例,并有不少地区做了多次修订,形成了一些立法亮点,主要体现于中医药特有领域的立法探索、安全合理用药监管机制的构建、中医药服务体系的健全、中医药宣传日的推广等方面,但仍有优化空间。此外,中医药地方立法仍有不少需要重点突破之处,如中医医术确有专长人员的扶持与管理、自种自采自用中药的监管、突发公共卫生事件的中医药参与机制等。通过对地方立法对贯彻《中医药法》的重要性、中医药地方立法亮点的梳理与评析和中医药地方立法重点的研判与思考进行归纳总结,为各地立法经验的互鉴及立法体例的完善提供借鉴。At present,most regions in China have formulated local regulations on traditional Chinese medicine(TCM),and many of them have revised the local regulations several times,and have achieved some legislative highlights,which are mainly reflected in the legislative exploration of TCM special fields,the establishment of a safe and rational drug use supervision mechanism,the improvement of the TCM service system,and the promotion of TCM publicity days.However,there is still room for improvement.In addition,there are still many key breakthroughs to be made in local TCM legislation,such as the support and management of person indeed having specialty in medical skills,the supervision of self-planting,self-collecting and self-use of TCM,and the mechanism of TCM participation in public health emergencies.This paper summarizes the importance of local legislation to the implementation of the Law of Traditional Chinese Medicine,the highlights of local legislation of TCM,and the research and judgment on the focuses of local legislation of TCM,so as to provide reference for the mutual learning of legislative experience and the perfection of legislative styles in different regions.
