摘　　要：CISG自2022年12月1日起在香港地区适用,但尚不能在澳门地区适用。本文选取律商网(lexiscn)数据库公布的中国法院涉及CISG的45份二审判决书显示,CISG在中国法院裁判实践中仍存在同案不同判的情况,这增加了商事主体在跨境贸易中的法律成本。本文梳理CISG在粤港澳大湾区适用的规则并进行理论分析后得知,对于促进CISG在粤港澳大湾区的统一适用,可采取以下对策:以CISG在香港地区适用的实践推动CISG尽快在澳门地区的适用;优化CISG适用的程序法环境;定期评估CISG的适用效果;培养法律共同体接受并正确适用CISG。CISG has been applicable in Hong Kong since 1 December 2022,but is not yet applicable in Macao.The 45-second-instance judgments of Chinese courts involving CISG published in the Lexiscn database show that there are still different judgments on CISG in Chinese court practice,which increases the legal costs of commercial entities in cross-border trade.After sorting out the rules of CISG application in the Guangdong-Hong Kong-Macao Greater Bay Area and conducting a theoretical analysis,this article shows that the following countermeasures can be taken to promote the uniform application of CISG in the Guangdong-Hong Kong-Macao Greater Bay Area,using the practice of CISG application in Hong Kong to promote the application of CISG in Macao as soon as possible;optimizing the procedural law environment for CISG application;regularly evaluating the effectiveness of CISG application;and fostering the acceptance and proper application of CISG by the legal community.
