规划改革背景下英国地方规划审查的特征与启示

摘　　要：市县国土空间总体规划的编制与审查审批是当前我国国土空间规划工作的重点,英国近年来的地方规划审查实践响应了“地方化”规划改革趋势,具有一定借鉴意义。文章分析了规划改革背景下英国地方规划编制和审查批准的主要程序,归纳了以规划督察署为专门审查机构、以合理性和合法性为主要审查内容、以听证会为主要形式的审查过程等主要做法,提炼出以审查助力规划传导、“地方化”改革影响显著、保障公众参与和信息公开、强调规划动态完善等重要特征。最后,针对当前我国市县国土空间总体规划审查提出三点建议:一是细化审查权责,建立第三方技术审查机制;二是统筹规划编制、审查审批与实施,推进规划动态维护;三是保障公众参与,发挥规划审查的权利救济功能。Compilation,examination,and approval of the overall town and county planning is the focus of current spatial planning in China,and UK’s local planning review in recent years has certain reference significance for us since it conforms to the trend of“localization”in planning reform.This paper first analyzes the main procedures of the compilation,examination,and approval of local planning in the UK under the background of planning reform.Then this paper summarizes the main practices in the review process with the Planning Inspectorate as the particular review agency,with rationality and legitimacy as the key review content,and with hearing as the main working pattern,extracting such key features as reviewing to help planning transmission,the significance of“localized”reform,ensuring public participation and information transparency.Finally,this paper puts forward three suggestions for the current review of overall town and county planning in China:to clarify rights and duties during a review and establish a mechanism of third-party technical review;to adopt overall planning of compilation,examination,approval,and implementation,and promote dynamic maintenance of planning;to ensure public participation,and achieve the goal of right relief through planning review.
