摘　　要：平台互联互通符合开放、自由、共享的互联网精神。互联互通有利于促进协同高效的数字法治政府建设,有利于建立开放的平台生态系统而促进平台经济高质量发展,有利于使用户享受便捷、高效、个性的数字服务。互联互通存在弊端,可能导致平台的竞争利益受到影响、运营成本增加、责任加重、用户体验度降低等后果,可能导致“搭便车”、算法共谋等现象。互联互通可能不利于建立清晰的数据产权制度,导致数据要素收益分配效率与公平的失衡,加大数据安全风险。应以市场在资源配置中起决定性作用和更好发挥政府作用为准则,有效区分公共机构和私主体,在法治轨道上理性推进互联互通。应充分尊重平台的经营自主权,正确认定“恶意不兼容”和数据垄断。为了保障互联互通的有序性、高效性和安全性,应科学合理设定数据产权制度,并不断提升数据安全保障水平。Platform Interconnection conforms to the spirit of openness,freedom,and sharing of the internet.Interconnection is conducive to the construction of a collaborative and efficient digital rule of law government,the establishment of an open platform ecosystem and the high-quality development of platform economy,and the enjoyment of convenient,effi cient and personalized digital services by users.Diffi culties in interconnection may aff ect the interests of platform competition,increase operating costs,increase responsibilities,reduce user experience and other consequences,which may lead to"free riding",algorithm collusion and other phenomena.Interconnection may be detrimental to the establishment of a clear data property rights regime,resulting in an imbalance between effi ciency and equity in the distribution of data element benefits,and increasing data security risks.The market should play a decisive role in resource allocation and the government should better play its role as a guideline,eff ectively distinguish between public institutions and private entities,and rationally promote interconnection on the rule of law track.The operational autonomy of platforms should be fully respected,and"malicious incompatibility"and data monopoly should be correctly identifi ed.In order to ensure the orderliness,effi ciency and security of interconnection,it is necessary to set up a scientific and reasonable data property rights system and continuously improve the level of data security.
