人身保险合同财产性权益强制执行法律问题刍议

摘　　要：囿于我国法律及司法解释对人身保险合同财产性权益的可执行性未作明确的规定,致使理论界和司法实务界对此一直存在较大的争议。能否对人身保险合同财产性权益加以强制执行不应一概而论。文章通过对民事执行、保险法及相关司法解释关于保费、保单现金价值以及“介入权”规则的理论分析,结合民法典人格权保护的精神,认为对于人身保险合同中的财产权益部分可以强制执行,而涉人身权的部分则不宜强制执行。人身保险合同财产性权益的强制执行应对所涉及的公共利益和私人利益、债权人利益与被保险人利益、强制执行权与民事权利保障等议题加以考量,对于纯人身保障的人身保险合同财产性权益则应当豁免执行。due to the lack of clear provisions on the enforceability of the property rights and interests of life insur-ance contract in China's laws and judicial interpretations,there has been a great controversy in the theoretical and ju-dicial circles.Whether to enforce the property rights and interests in the life insurance contract should not be general-ized.The property rights and interests in the life insurance contract can be enforced,but the part involving personal rights should not be enforced.The enforcement of property rights and interests of life insurance contract should be considered in terms of public interest and private interest,creditor's interest and insured's interest,enforcement right and civil rights protection,etc.the property rights and interests of personal insurance contract with pure personal pro-tection should be exempted from execution.
