利害调整模式下公权利理论的革新

摘　　要：随着多元行政法律关系的产生,具有二元构造特征的传统公权利理论出现危机。以自由等价和人格主义为基础,以水平私益冲突为核心,普罗伊斯建构了多元行政法律关系中判断公权利的利害调整模式。通过区分权利分配与请求权指向这两个维度,利害调整模式实现了私人间水平关系与国家和私人之间垂直关系的整合。在多元行政法律关系中,不仅公权利的内涵有所不同,而且法律之于公权利证成的作用得以凸显。利害调整模式立足于行政法律关系理论,优化了公权利的判断方法,推动了公权利理论的发展。面对多元行政法律关系中的复杂利益结构,我国也可以借鉴利害调整模式,完善冲突利益的协调机制,实现无漏洞的权利保护。With the emergence of multilateral administrative legal relationships,the crisis of the traditional theory of subjective public right with the characteristics of bilateral structure has emerged.Based on the concepts of equivalence of freedom and personality,and with the horizontal private interest conflict as the core,Matthias Schmidt-Preu?has constructed a conflict coordination pattern for judging subjective public rights in multilateral administrative legal relationships.The conflict coordination pattern distinguishes between the two dimensions of right-distribution and claims.As a result,the horizontal relations between private individuals and the vertical relations between the state and the citizens are consolidated.In the multilateral administrative legal relationships,not only the content of subjective public right is different,but also the normative role of law and fundamental rights has been emphasized.Based on the theory of administrative legal relationship,the conflict coordination pattern realizes the optimization of the interpretation of legal norms and thus promotes the development of the traditional theory of subjective public right.Faced with the complicated interest structure in the multilateral administrative legal relationship,China can also learn from the conflict coordination pattern and improve the coordination mechanism of conflicting interests,so as to realize the complete protection of rights.
