电商平台“二选一”行为的相关市场界定问题研究——以“阿里巴巴”案和“食派士”案为视角

摘　　要：电商平台“二选一”行为涉嫌滥用市场支配地位,损害竞争。规制“二选一”垄断行为,首先要解决界定相关市场的问题。因多边市场构造下平台具有锁定效应、传导效应、交叉网络外部性等特征,传统界定方式面临商品功能界定困难、平台相关市场划分困难、假定垄断者测试界定法失灵等困境。尽管如此,相关市场界定作用和地位不容忽视,其筛选功能有助于明确竞争关系、确定市场参与者、评估市场力。完善相关市场界定,一是区分“应用层面”与“平台层面”以保护创新;二是以平台核心业务界定相关市场;三是从典型案例中总结启示,包括需求替代定性分析与假定垄断者测试定量分析相结合、坚持透明度原则、探索线上与线下市场替代关系问题。The"two-choice"behavior of e-commerce platforms is suspected of abusing market dominance and damaging competition.To regulate the monopolistic behavior of"two choices",we must first solve the problem of defining the relevant market.Due to the locking effect,conduction effect and cross-network externality of platform under the multilateral market structure,the traditional definition method is faced with difficulties in the definition of commodity functions,the division of platformrelated markets,and the failure of the testing and definition method of assumed monopolists.Nevertheless,the role and status of the relevant market can not be ignored,and its screening function helps to clarify competitive relationships,identify market participants,and assess market power.Improve the relevant market definition,first,distinguish the"application level"and"platform level"to protect innovation;Second,the core business of the platform defines the relevant market;The third is to sum up the enlightenment from typical cases,including the combination of qualitative analysis of demand substitution and quantitative analysis of presumed monopolist testing,adhering to the principle of transparency,and exploring the substitution relationship between online and offline markets.
