摘　　要：2008年金融危机以来,各国大多倾向选择内向性和保守性的经济政策,外资安全审查趋严,技术管控升级;美国等发达国家利用国际经济合作由贸易合作向生产合作深化,积极推动国际经贸规则由与贸易相关的关税规则向与生产相关的市场规则变迁,将本国在竞争政策等领域的国内法国际化,试图形成新的制度领跑优势,并利用制度规则特有的排异性效应,为发展中国家的企业带来新的合规性困境;个别发展中国家推动本国BIT范本由“投资保护协定”向中性的“投资协定”转变。为应对这些调整,中国应建设高水平市场经济与开放体制;联合广大发展中国家,反对发达国家在投资规则上的霸权主义;坚持多边主义,主动分享中国渐进式开放在外资政策制定上的经验与做法,并与部分发展中国家修订完善双边投资协定;探讨将国内一些政策实践上升为国际规则的可行性。Since the financial crisis,most countries in the world tend to choose introverted and conservative national economic policies,and the national security review of FDI has become stricter with technical control upgraded;The developed countries led by the United States take advantage of the deepening of international economic cooperation from trade cooperation to production cooperation,actively promote the change of international rules from trade-related tariff rules to production-related market rules,internationalize their domestic rules in the fields of competition policy and etc.,try to form new institutional gaps and institutional leading advantages,and make use of the unique exclusion effect of institutional rules and bring new compliance difficulties to enterprises in developing countries.Some developing countries are trying to revise their BIT as well as promoting the transformation of BIT function from“investment protection agreement”to neutral“investment agreement”.In response to these adjustments,China should build a high-level market economy,unite with the vast number of developing countries to oppose the hegemonism of developed countries in investment rules,adhering to multilateralism,actively share China’s experience and practices in formulating foreign investment policies for gradual opening-up,and revise bilateral investment agreements with some developing countries and To explore the feasibility of upgrading domestic policies into international rules.
