跨行政区环境执法管理机制运行现状及优化路径

摘　　要：我国现有三种跨行政区环境执法管理模式,分别是跨流域(地域)执法管理模式、督察模式和区际联合执法模式。既有模式存在主体权限交叉重叠、信息共享失灵滞后、考核问责落实不力、生态补偿和财政转移支付失衡等问题,对此应规范对区际执法管理主体的合理授权,确保其职责清晰化和运行制度化;加强数字技术在环境执法管理领域的应用,推进区际执法管理“云端化”和智慧化;增强行政协议刚性约束力,完善诚信评价体系和考核监督机制,使行政协议履行实质化和考核明确化;优化区际生态保护补偿的标准与结构,明确补偿事权与责任的划分,调整财政转移支付资金的使用方式,实现生态保护补偿与财政转移支付的衡平化和标准化。There are three kinds of environmental law enforcement management models across administrative regions in China,namely,the cross-basin(regional)law enforcement management model,the supervision model and the interregional joint law enforcement model.The existing model has problems such as overlapping of subject authority,failure of information sharing,poor implementation of assessment and accountability,and imbalance of ecological compensation and financial transfer payment.Therefore,it is necessary to standardize the reasonable authorization of the inter-regional law enforcement management subject to ensure its clear responsibilities and institutionalized operation;Strengthen the application of digital technology in the field of environmental law enforcement management,promote the“cloud-based”and intelligent interregional law enforcement management;Strengthen the rigid binding force of the administrative agreement,improve the integrity evaluation system and the assessment and supervision mechanism,and make the implementation of the administrative agreement substantive and the assessment explicit;Optimize the standards and structure of interregional ecological protection compensation,clarify the division of compensation powers and responsibilities,adjust the use of financial transfer payment funds,and realize the balance and standardization of ecological protection compensation and financial transfer payment.
