土著人民传统生态知识国际法律保护的弊失及其匡治

摘　　要：传统生态知识业已广受关注和重视,诸多国际法律文件对其予以保护。但囿于相关国际组织众多且分散、土著民族位处弱势地位、土著人民传统观念与现代社会冲突,传统生态知识保护存在保护体制上的边缘化、立法上的碎片化、机制上的残缺化等诸多弊处,亟待寻求改进之道。鉴于此,以观念变革推动保护立法向以平等主义为核心的方向转变,寻求保护格局的利益均衡,加强保护立法和平台建设,推进国内保护与国际保护机制的衔接和完善,多元保护路径加强保护治理,以真正实现有效保护。Traditional ecological knowledge has received much attention,and many international legal documents have protected it.However,due to the numerous and scattered international organizations,the disadvantaged position of indigenous people and the conflict between traditional concepts of indigenous people and modern society,the protection of traditional ecological knowledge has many shortcomings such as marginalization in the protection system,fragmentation in the legislation,and mutilation in the mechanism which are urgent to find ways to improve.In view of this,we should promote the change of conservation legislation to the direction of egalitarianism,seek the balance of interests in the conservation pattern,strengthen the construction of conservation legislation and platform,promote the convergence and improvement of domestic conservation and international conservation mechanisms,and strengthen conservation governance through multiple conservation paths in order to truly achieve effective conservation.
