摘　　要：生态环境损害是对环境生态功能、生态服务的破坏与损伤,其实质是侵害了不特定主体所享有的环境权益。环境权益虽为不特定主体所共享、共用,具有公共利益的属性,但对于每一个特定主体而言,不能因此否认其对环境权益的享用状态。我国《民法典·侵权责任编》将生态环境损害纳入其救济范围,实际上是肯定了侵权法对环境权益的保护,确立了生态环境损害的侵权法直接救济模式。相对于通过人身、财产损害救济生态环境损害的间接救济模式而言,直接救济模式不仅是侵权法对生态文明建设、绿色发展理念的回应,是贯彻我国《民法典》“绿色原则”的内在要求,更重要的是其能有效克服间接救济模式的弊端,为生态环境损害救济提供实体法上的依据。The ecological environmental damage is the destruction of ecological functions and damage to ecological services,and its essence is the infringement of the environmental rights and interests enjoyed by unspecific subjects.Although the environmental rights and interests are shared by unspecific subjects and have the attribute of public interest,the enjoyment of environmental rights and interests can’t be denied for each specific subject.The tort liability part of Chinese civil code includes ecological environmental damage into its relief scope,which affirms the protection of environmental rights and interests by tort law and establishes a direct relief mode of tort law on ecological environmental damage.Compared with the indirect relief mode of relieving ecological environmental damage through personal and property damage relief,the direct relief mode is not only the response of tort law to the construction of ecological civilization and green development idea,but also the inherent requirement of implementing the“green principle”of Chinese civil code.More importantly,it can effectively overcome the shortcomings of the indirect relief mode and provide the basis of substantive laws for ecological environmental damage relief.
