摘　　要：作为公权力的行政经济管理权在对市场经济活动进行调控的过程中具有正反两方面的影响,既能有效维护市场竞争秩序、促进经济的发展,也会被过当使用,阻碍市场经济活动的公平进行。因此应当依据经济民主的原则,合理设置行政经济管理权力的内容和结构,防止其对自由市场经济竞争造成威胁,以经济民主的原则对之加以法律规制。As a public power,the right of administrative and economic management has positive and negative effects in regulating market economic activities.It cannot only effectively maintain the order of market competition and pro⁃mote economic development,but may also be used excessively to hinder the fair progress of market economic activi⁃ties.Therefore,under the principle of economic democracy,the content and structure of the right of administrative and economic management should be reasonably set up to prevent it from posing a threat to free market economic competition,and to regulate it legally according to the principle of economic democracy.
