摘  要:依法治校是现代高校治理的基本理念,也是推进中国特色、世界一流大学建设的重要一环。高校教学事故认定应当在依法治校的框架下,以法治的思维和方式保障教学秩序的开展,解决教学纪律问题,化解矛盾纠纷。然而,当下教学事故认定存在责任统一而认定不一的矛盾现象。不少高校在教学事故办法的调整对象、事故定义、适用范围、程序效力等方面存在较大差异,甚至存在合法性的问题,应当引起足够重视。对此,应当尽快制定教学事故认定的行政解释,并在教师合法权益保障、教学事故认定范围和制定程序等方面完善各高校的教学事故认定办法。"Governing the School According to Law"is the fundamental concept of modern university governance,and it is also an important aspect of promoting the construction of world-class universities with Chinese characteristics.The identification of teaching accidents in higher education institutions should be carried out within the framework of"Governing the School According to Law,"using legal thinking and methods to ensure the orderly development of teaching,solve disciplinary problems,and resolve conflicts.However,there is a contradiction between the unified responsibility and inconsistent identification of teaching accidents at present.Many universities have significant differences in the adjustment objects,accident definitions,application scope,and procedural effectiveness of their teaching accident measures,and even have legitimacy issues,which should be given sufficient attention.Therefore,it is necessary to develop administrative interpretations of teaching accident identification as soon as possible and improve the teaching accident identification measures of each university in terms of protecting the legitimate rights and interests of teachers,the scope of teaching accident identification,and the development procedures.
