民法典背景下实际施工人权利保护制度评析

摘　　要：为了保护农民工利益,我国司法解释创设了实际施工人权利保护制度,该制度对我国建设工程施工领域的司法实践产生了重要影响。文章梳理了该制度的创设背景、具体内容、实践中存在争议的问题,综合分析了先后三部司法解释和《民法典》等法律中该制度的相关规定,发现在《民法典》背景下实际施工人权利保护制度得到了延续和完善,但《民法典》对该项制度的回应十分有限,亟须从立法层面对实践中存在争议的问题予以规制。To protect the interests of migrant workers,China has established a system for protecting the rights of actual constructor,which has exerted a significant impact on the judicial practice.Accordingly,the thesis sorted out the background,content and controversies in the practice of the system,comprehensively examined the relevant provisions of the system in three judicial interpretations and civil code.It’s found that although the system has been retained and improved in civil code,the interpretation was very limited,thus making it urgent to address the controversies arised in practice from the legislative level.
