房屋征收补偿行政案件中承租人的原告资格研究

摘　　要：在房屋征收补偿行政案件中承租人的救济路径问题上,由于法律规定不明、裁判标准不一,导致承租人司法救济时常陷入窘境之中。赋予承租人行政诉讼原告资格,既是公法上公民居住权保护的现实必要,又体现出对弱势群体利益的倾斜性司法保护,能够产生实质性解决征收安置补偿争议的效能,亦与行政诉讼原告资格扩张趋势保持一致。公有福利性住房承租人应当拥有完整的原告主体资格;公共保障性住房承租人和以租赁房为唯一居所的承租人可以基于居住权提起课予义务之诉;承租人对承租房屋有不可分割的添附以及装修装饰的,可以就征收安置补偿协议、征收补偿决定提起撤销之诉和给付之诉;经营性房屋承租人还可以就停产停业损失主张权利。In the administrative case of compensation for housing expropriation,the lessee's judicial relief is often in a dilemma due to unclear legal provisions and different adjudication standards.Granting the lessee the qualification of plaintff in administrative litigation is not only a practical necessity for the protection of citizens'right of residence in public law,but also reflects the preferential judicial protection of the interests of vulnerable groups,which can produce the effectiveness of substantively resolving disputes over expropriation and resettlement compensation,and is also consistent with the trend of expansion of the qualification of plaintiffs in administrative litigation.The lessee of publicly-owned welfare housing should have complete plaintiff subject qualifications;the lessee of public affordable housing and the lessee with the leased housing as the only residence may file an action for obligation on the basis of the right of residence;the lessee having inseparable additions and decorations to the leased house may launch an action of revocation or prestation against the expropriation compensation agreement and the expropriation compensation decision;the lessee of production and operation housing can also claim the right for the losses resulted from suspension of production or business operation.
