摘　　要：以习近平法治思想要义,对“健康中国”战略法治体系建设的法理基础、制度安排以及路径选择作探索,提出以人民健康为核心、宪法权利为根本、公平正义为理念来促进“健康中国”战略法治体系的理论构建;以加强基层为核心推动分级诊疗制度、以公益属性为理念推动公立医院管理、以保障健康为目标推动医疗保障制度、以安全有效为标准推动药品和医疗器械供应保障制度等方面的法律化,来推进“健康中国”战略法治体系的制度构建;以坚持中国共产党领导、中国特色、中西医结合和保基本强基层的卫生健康法治道路,来推进“健康中国”战略法治体系路径探索等建议。Based on Xi Jinping thought of the rule of law,this paper explores the legal basis,institutional ar⁃rangement and path selection of the construction of"healthy China"strategic rule of law system,and puts forward the following suggestion:promoting the theoretical construction of"healthy China"strategic rule of law system by taking people's health as the core,constitutional rights as the foundation,fairness and justice as the concept;promot⁃ing the institutional construction of the"healthy China"strategic legal system by promoting hierarchical diagnosis and treatment system with strengthening the grassroots as the core,promoting public hospital management with the concept of public benefit,promoting medical security system with health as the goal,and promoting the legalization of drug and medical device supply guarantee system with safety and effectiveness as the standard;exploring ways to promote a"healthy China"strategic rule of law system by adhering to CPC's leadership,Chinese characteristics,the combination of Chinese traditional and Western medicine,and the health rule of law of ensuring and strengthening the grassroots.
