摘　　要：医院中药制剂备案制度的提出激励了医疗机构医院制剂的研发,也使知识产权保护问题凸显。分析医院中药制剂知识产权保护的现状和所存在的问题,结合国内外传统知识数据库的建设情况,本文提出结合二者,尝试思考从法律视角探索医院中药制剂数据库保护的方法和路径:正视数据库建立的最大困难,在于其信息共享机制中私有权利的无国界化发展与现有知识产权保护制度私法属性间的矛盾,故数据库的构建必须重视其与现有知识产权制度的衔合,明确医院制剂数据产权,保护持有主体合法权益,构建技术秘密转移渠道。The establishment of the record system of hospital TCM preparations has stimulated the research and development of hospital preparations in medical institutions and highlighted the problem of intellectual property protection.By analyzing the current situation and existing problems of intellectual property protection of TCM prepa⁃rations in hospitals,and combining with the construction of traditional knowledge databases at home and abroad,this paper proposes to think about the methods and paths to explore the protection of TCM preparations database in hospi⁃tals from the legal perspective:the biggest difficulty in the establishment of database lies in the contradiction be⁃tween the borderless development of private rights in its information sharing mechanism and the private legal attri⁃bute of the existing intellectual property protection system.Therefore,the construction of database must attach impor⁃tance to its integration with the existing intellectual property system,clarify the property rights of hospital prepara⁃tion data,protect the legitimate rights and interests of the holders,and construct the transfer channels of technical se⁃crets.
