“健康码”集成个人健康信息之保护所面临的困境及其对策研究

摘　　要：由分析“健康码”集成个人健康信息保护而梳理了其所涉及的相关法律体系不完善、个人健康信息权益遭受公权力挤压、存在数据有被泄露的风险、信息收集超出必要限度、虚置知情同意条款以及政策执行中的偏差等问题;认为可通过完善法律体系、加强个人健康信息管理、坚守知情同意原则和最小必要原则、减少政策执行偏差等,来保护个人健康信息权益并供未来数字化治理借鉴,以推进我国突发公共卫生事件治理体系和治理能力现代化。By analyzing the protection of personal health information integrated in"health code"to protect,this paper summarizes the problems related to the imperfect legal system,the squeezing of personal health information rights and interests,the risk of data being leaked,the information collection exceeding the necessary limit,the false provision of informed consent and the deviation in policy implementation,and argues that we can protect the rights and interests of personal health information and provide reference for future digital governance by improving the le⁃gal system,strengthening the management of personal health information,adhering to the principle of informed con⁃sent and the minimum necessary principle,and reducing the deviation of policy implementation,so as to promote the modernization of public health emergency management system and management ability.
