摘 要:农村民间金融能够较好地弥补农户和新型农业经营主体的融资缺口,是农村金融市场不健全和不完善的产物,是一种过渡金融体制。当下农村民间金融的治理难题归根于相关法律供给的异化,尤其是硬法规制模式的乏力甚至失灵。法经济学视阈下,软法可以发挥其在创制方式、立法成本、规范架构、实施机制等方面的比较优势。农村民间金融软法治理应秉持金融公平、金融效率、金融共享和绿色金融的价值理念,彰显社会公权力的治理效用、声誉机制的外溢效力、激励约束机制的常态化以及非司法中心主义的路径依赖,并在软硬法有机协同下推动农村民间金融的高质量发展,助力乡村振兴和共同富裕。Rural informal finance can better make up for the financing gap of farmers and new agricultural business entities,which is a product of the incomplete and imperfect financial market and is a transitional financial system.The current governance problems of rural informal finance are rooted in the alienation of the relevant legal supply,especially the weakness or even failure of the hard law regulation model.From the perspective of law and economics,soft law can give full play to its comparative advantages in creation mode,legislative cost,normative framework,implementation mechanism and so on.The soft law governance of rural informal finance should adhere to the value concepts of financial fairness,financial efficiency,financial sharing and green finance,highlight the governance effectiveness of social public power,the spillover effect of reputation mechanism,the normalization of incentive and restraint mechanism and the path dependence of non-judicial centralism,and promote the high-quality development of rural informal finance under the organic coordination of soft and hard laws to help rural revitalization and common prosperity.
