摘　　要：中华优秀传统法律文化是我国建设依法治国道路的理论土壤与文化根基。民族自治地方刑法变通补充规定是我国民族区域自治制度的重要内容。民族自治地方刑法变通补充规定深受传统法文化的影响,彰显了传统法文化智慧的结晶。传统法文化是刑法变通补充规定的重要来源与文化底蕴。民族自治地方无法全部适用刑法时,权力机关可以依据当地的政治、经济、文化特点并且在不违反刑法基本原则的前提下对刑法进行变通或补充。刑法进行变通补充的原因是刑法与民族习惯规则存在冲突。从理论逻辑上看,冲突产生的根源在于法律与文化的背离以及刑罚目的缺失。从历史逻辑上看,对刑法变通补充是我国历史上政权所采取的缓和国家制定法与民族习惯规则冲突维护民族团结的有效方式。刑法变通补充规定蕴含了民为邦本的民本思想,彰显了德法合治的治国理念。Traditional legal culture has been providing solid foundation for rule by law in China.Flexible implementation of criminal law,which fits specific conditions of minority ethnics,and forms a vital tool to achieve criminal justice,is influenced by those traditional wisdoms.In other words,traditional heritage guides the flexible implementation of criminal law profoundly,while criminal law may not be always directly applied to minority ethnics,authorities have powers to decide how to apply criminal law or even make supplementations,considering needs of local political,economic and cultural situation.Those situational changes in legal application,reflects conflict between criminal law and local ethnic culture,and may be seen as an inconsistent between legal principle and cultural actuality.In furtherance,conflicts and inconsistences cause problems of failure of penalty purpose in theory,but actually are resolved by historical experience,in which,ancient rulers have been using criminal legal supplementations,to cope with different minority group under the same national criminal law,and effectively maintain national wide ethnical harmony.To conclude,criminal flexible supplementation is firmly based on principles of "rule by the people" and "advancing social governance by both ethics and laws".
