摘　　要：基于TAPED数据库所列条款构建数字贸易规则框架,使用文本研究方法可以对“十四五”期间上海实施的相关政策文件进行对比和分析,并进一步分析上海对接数字贸易规则时面临的现实困境。研究发现:上海对接数字贸易规则的条款数目与内容深度不断上升,特别是在数字贸易便利化及合作领域已形成诸多有益的实践与案例。但在对接数字贸易壁垒、数字贸易营商环境、政府义务及数字贸易监管等标准高、争议大的议题方面仍存在不足。数字贸易规则的非一致性,中国缺乏自主导向的数字贸易规则及数字治理体系欠缺成为制约上海对接高标准数字贸易规则的因素。因此,上海需通过建立并完善跨境数据流动管理体系,主动对接高标准数字贸易规则,增强消费者信心,加速政府数据开放,加强国际交流合作等举措,推动高标准数字贸易规则的对接进程,为构建数字贸易规则的“中国方案”积累经验。Based on the clauses listed in the TAPED database,this paper constructs a framework of digital trade rules.Using the text research method to compare and analyze the relevant policy documents implemented in Shanghai during the period of“14th Five-Year Plan”,the paper further analyzes the realistic dilemma faced by Shanghai when applying the digital trade rules.The results show that the number and content depth of the provisions of Shanghai’s digital trade rules are increasing,and what is particularly noteworthy is that a myriad of beneficial practices and cases have been collected in the field of digital trade facilitation and cooperation.However,there are still deficiencies in some controversial issues that require high standards,such as response to digital trade barriers,digital trade business environment,government obligations,digital trade regulation.The inconsistency of digital trade rules,the lack of self-oriented digital trade rules,and the deficiency of digital governance system in China,have become the factors restricting Shanghai’s catch-up with high-standard digital trade rules.Therefore,Shanghai needs to take forceful measures including establishing and improving the cross-border data flow management system,taking the initiative to align itself with high-standard digital trade rules,enhancing consumer confidence,accelerating the opening of government data,and strengthening international exchanges and cooperation,in order to promote the aligning process and accumulate experience of“China solutions”to the establishment of digital trade rules.
