摘　　要：我国监察体制改革以来,在对可能构成职务犯罪的腐败行为的处置方式中,以“断崖式降级”为代表的党纪政务处分所占比例逐渐提高。对此,理论界出现了“以罚代刑”不可取的质疑声音。这一问题出现的根本原因在于纪法衔接的不畅。《监察法》与《刑法》二者位阶平等、目标相同、内容共通,这是纪法衔接的重要基础。监察对象的范围广于职务犯罪主体,不仅是对其合理有益的补充,也是纪法衔接的重要表现。特定情形职务犯罪非罪化处置具有合理性,在由以惩治为主转为以预防为主的腐败治理新模式中,这是实现纪法衔接的一种新举措。党纪政务处分足以实现刑罚的惩罚性和刑法的特殊预防功能,也是落实“治病救人”和“四种形态”方针政策的具体方式。在具体适用过程中,应加强纪检监察机关内部的管理,并允许司法机关一定程度的参与,将能更好地推进纪法衔接。Since the reform of China's supervisory system,the proportion of Party discipline and government punishment represented by “cliff demotion” has gradually increased in the handling of corruption that may constitute a crime in office.In this regard,there has been a questioning voice in the theoretical community that “substitute fines for criminal punishment” is not advisable.The fundamental reason for this problem lies in the poor connection between discipline and law.The Supervisory Law and the Criminal Law have equal ranks,similar goals,and common content,which is an important basis for the convergence of discipline and law.The fact that the scope of the subject of supervision is wider than that of the subject of duty crimes,which is not only a reasonable and beneficial supplement to it,but also an important manifestation of the convergence of discipline and law.The decriminalization of duty crimes in specific situations is reasonable,and this new model of corruption governance that focuses on punishment instead of prevention is a new measure to achieve the convergence between discipline and law.The Party discipline and government punishment is sufficient to achieve the punitive nature of criminal punishment and the special preventive function of criminal law,and is also a concrete way to implement the policies of “treating diseases and saving people” and “four forms”.In the specific application process,it is necessary to strengthen the internal management of disciplinary inspection and supervision organs and allow judicial organs to participate to a certain extent,which will better promote the convergence between discipline and law.
