摘 要:新就业形态劳动者职业伤害保障目前试点中存在部分加入式工伤保险、单工伤保险、职业伤害保险三种保障模式,比较域外对类似劳动者采取的工伤保险、商业保险和职业伤害保险差异,提出依赖传统工伤保险的治理机制来构建全新的统一职业伤害保险是可行之选,即适用传统工伤保险的治理机理,以守正创新的思路构造包括新就业形态劳动者在内的统一职业伤害保险制度,以从业和持续性收入为参保条件,科学设计用人单位、各类经济组织及平台企业强制缴费规则,平等待遇支付,实现新就业形态劳动者包括全体职业劳动者职业风险权益保护。At present,the rights and interests of the new employment patterns have aroused close attention at home and abroad.In recent years,relevant authorities have released multiple documents,proposing to guarantee the occupational injury protection and actively initiated some pilot work.This paper compares the pros and cons of occupational injury protection model of new employment pattern in six regions in Shandong including Weifang,as well as in Germany,the Netherlands,and Malaysia,in order to explore a path applicable to China.It is to build a unified occupational injury insurance system covering workers of new employment with positive innovation based on the governing mechanism of traditional work injury insurance,employment and sustainable income as the insurance condition.Rules for compulsory payment by employers,various economic organizations,and platform enterprises need to be reasonably worked out to promote equality in treatment,and the social protection function of occupational injury insurance,so as to protect professional rights and interests of new employment workers from risks.
