陆陇其的司法审判思想探析

摘　　要：《陆稼书判牍》一书收录了陆陇其在嘉定县和灵寿县为官时审理案件所作的判词,经过对这些判词进行阅读和研究发现,陆陇其有着丰富的司法审判思想,包括依法审判的思想,重惩罪犯、以儆效尤的思想,教化调解的思想以及情理法相结合的思想,其最终目的是为了更好地裁判案件、解决纠纷。陆陇其在审判某些案件时将情、理、法相结合,既解决当事人的纠纷,也得到了大众的信服。这一司法审判观念与方式,对丰富当下我国的多元纠纷解决机制也有着重要意义。The book Lu Jiashu's Verdicts contains the judgments made by Lu Longqi when he was an official in Jiading County and Lingshou County.After reading and studying these judgments,we find that Lu Longqi has rich thoughts on adjudication including the idea of judging according to law,the idea of severe punishments on criminals as warning examples for others,the idea of enlightenment and mediation,and the idea of a combination of sentiment,reason and law.The ultimate goal of his thoughts on adjudication is to better adjudicate cases and resolve disputes.When trying certain cases,he combined sentiment,reason and law,which not only resolved the disputes between parties but also won the public's conviction.This concept and method of adjudication are still of great significance in enriching the current diversified dispute resolution mechanism in China.
