摘　　要：数字时代,交织在人民法庭中的客观张力和多重掣肘进一步凸显,人民法庭面临有效推进司法之治的全新挑战。在“枫桥经验”由地方经验跃迁至国家政策的过程中,“枫桥式”人民法庭应运而生,成了破解基层司法之治难题的理想方案。与此同时,基层司法之治的复杂特性贯穿于“枫桥式”人民法庭运作的始终,这对新时代人民法庭的顺势转型提出了更高要求。韧性治理模式迎合了推动人民法庭转型的客观需求,也为检视人民法庭运作实效提供了分析框架。这一模式从理念、组织、过程维度为“枫桥式”人民法庭的优化转型铺就了转型路径。在理念维度上,需要以回归“枫桥经验”法治基因的方式促进技术与价值理性之间的协调平衡;在组织维度上,需要以优化法庭布局、注重裁判社会效应等方式为重振法庭功能寻找可行出路;在过程维度上,需要以强化在线调解的“合意”权威、实现社会化治理的方式为基层司法之治提供更多可资利用的资源。In the context of the digital era,the objective tension and multiple constraints intertwined in people’s courts are further highlighted,and people’s courts are facing new challenges that are difficult to effectively promote judicial governance.In the process of“Maple Bridge Experience”converting from local experience to national policy,the“Maple Bridge”people’s court emerged as the times require,becoming an ideal solution to solve the problem of grassroots judicial governance.At the same time,the complex nature of grassroots judicial governance runs through the entire process of the“Maple Bridge”people’s courts,which puts forward higher requirements for the smooth transformation of people’s courts in the new era.The resilient governance model caters to the objective needs of promoting the transformation of people’s courts and provides an analytical framework for examining the operational effectiveness of people’s courts.This mode paved the way for the optimal transformation of“Maple Bridge”people’s court from the dimensions of concept,organization and process.In terms of conceptual dimension,it is necessary to promote the coordination and balance between technology and value rationality by returning to the“Maple Bridge Experience”rule of law gene.In terms of organizational dimensions,it is necessary to find feasible ways to revitalize the functions of the court by optimizing the layout of the court and emphasizing the social effects of adjudication;On the process dimension,it is necessary to provide more available resource endowments for grassroots judicial governance by strengthening the“consensus”authority of online mediation and achieving social governance.
