摘 要:环境资源案件集中管辖现处改革探索阶段。各试点地方的改革进路歧异,使其形成“跨省级行政区划与省级行政单位内、省级行政单位间规则界分”的差异化格局,滋生改革目标认识歧义、组织载体无序设置、受案范围和诉讼程序欠协调等结构分歧、要素缺位问题。完善环境案件集中管辖,应对“尊重生态环境系统性、整体性的自然属性,以整体化生态司法替代碎片化保护”“保障环境资源案件审理科学性、专业性,以环境诉讼机制的专门化满足专业化审判需求”“消解地缘因素干扰,保障人民法院审判权独立行使”的三重改革目标,及内涵、特征、效力、外延等理论基础形成统一认知。在此基础上,进行集中管辖制度的改革举措完善。The centralized jurisdiction system of environmental cases is in the stage of reform.Due to the different local reform measures in each pilot area,the pattern of differences within each provincial administrative division is formed between cross-provincial administrative divisions and provincial administrative divisions.In the face of a series of problems caused by this pattern,such as the divergence of understanding of reform objectives,the lack of scientific standards for the establishment of jurisdiction courts,and the inappropriate rules for litigation procedures and scope of cases,reformers should follow the reform objectives of protecting the integrity of the ecological environment,improving the professionalism of environmental justice,and preventing the destruction of judicial independence,clarify the basic theories of the connotation,characteristics,effectiveness,and extension of the centralized jurisdiction system of environmental cases,and improve the reform means according to its requirements.
