地理标志权边界限定的困境及其脱解

摘　　要：由于地理标志权的不确定性,存在肆意扩张解释的风险,因而识别地理标志权边界限定的困境并探究其内在机理是清晰厘定地理标志权,优化地理标志制度的基础和前提。地理标志具有商标法、质量法和国际法规范对象的多元化特性,由此滋生的内生性矛盾是导致地理标志权边界限定陷入困境的根源。其实,链接因素和链接关系左右着地理标志的适用范围和排他性边界,地理标志权的边界就在这不甚明确的逻辑关系中被决定。有鉴于此,地理标志权边界限定困境的脱解应当从三个方面进行:其一,理顺地理标志与商标的关系,保持地理标志立法的独立性,坚持地理标志权由链接因素和链接关系基准限定,商标符号层面的排他性以声誉为拓展的立论;其二,明晰地理标志的客观链接因素和本质上决定的链接关系基准;其三,建立地理标志权退出机制,对于丧失和改变链接因素和链接关系的地理标志,及时清理。The uncertainty of geographical indication right leads to the risk of arbitrarily expanding interpretation.Therefore,addressing the dilemma of boundary limitation of geographical indication right and exploring its internal mechanism are the basis and premise of clearly determining geographical indication right and optimizing geographical indication system.Geographical indications have the diversified characteristics of the objects regulated by trademark law,quality law and international law,and the endogenous contradictions caused by them are the root of the predicament of the boundary limitation of geographical indications.In fact,the link factor and link relationship influence the scope of application and exclusive boundary of geographical indications,and the boundary of geographical indication right is determined in this unclear logical relationship.In view of this,the solution to the dilemma of boundary limitation of geographical indication right should be carried out from three aspects:first,straighten out the relationship between geographical indication and trademark,keep the independence of geographical indication legislation,insist on the argument that geographical indication right is limited by link factors and link relationship benchmark,and the exclusiveness of trademark symbol level is expanded by reputation;Second,clarify the objective link factors of geographical indications and the link relationship benchmark determined in essence;Third,establish the withdrawal mechanism of geographical indication right,and clean up the geographical indications that lose and change the link factors and link relations in time.
