摘　　要：数字时代,知情同意在个人私密信息保护适用中具有正当性,但存在现实和理论困境。结合知情同意在个人信息保护中的作用,并兼顾个人信息在数字经济中的价值,需破解该规则在个人私密信息保护中适用困境,具体可从内在和外在进路入手:内在进路上,网络用户需认真对待法律赋予的权利,树立牢固维权意识;外在进路上,国家需完善个人私密信息保护顶层制度设计,政府及社会应秉持个人私密信息事关人格尊严价值定位,网络科技企业及行业组织等主体应加强统一协调机制建设,学界进一步加强研究,以衡平个人私密信息保护和数字经济发展间关系。In the digital age,informed consent has a legitimate basis in the application of personal privacy information protection,but there are practical and theoretical dilemmas.Considering the role of informed consent in personal information protection and the value of personal information in digital economy,it is necessary to solve the application dilemma of this rule in the protection of personal private information.Specific from the internal and external approach:internal approach,network users need to seriously treat the rights granted by law,establish a firm sense of rights protection;On the way forward,the country needs to improve the top-level system design of personal private information protection,the government and society should uphold the personal private information is related to the value orientation of personal dignity,network technology enterprises and industry organizations and other subjects should strengthen the construction of unified coordination mechanism,further strengthen the theoretical research,in order to balance the relationship between the protection of personal private information and the development of digital economy.
