摘 要:当前我国环境保护法律制度体系存在两类相似的生态环境损害的司法救济路径,即生态环境损害赔偿诉讼和环境公益诉讼(以下简称“两诉”)。由于“两诉”的机制类似、功能重叠,它们之间既需做出区分、又需填补衔接规则。在司法实践中,“两诉”衔接的方法路径不一,综合视之,各有利弊。针对“两诉”并轨之现状,应进行“诉前”与“诉中”规则之填补,在探索必要共同诉讼之路的同时,也当厘清诉讼优先顺位和相关机构之间的职权定位,明确在生态环境保护领域行政权优先于司法权,以便发挥环保行政机关的优势地位、利用其优势资源。与此同时,充分并合理发挥社会组织和检察院的作用,以此促进不同体制之间的有效衔接,实现更为有效的生态环境损害救济。At present stage,there are two similar judicial remedies for ecological damage in China’s environmental protection legal system,namely,ecological damage compensation litigation and environmental public interest litigation(hereinafter referred to as"two litigations").Since the mechanisms of"two litigations"are similar and their functions overlap,they must be distinguished from each other,and their legal connection rules must be established.In judicial practice,there are different methods and paths for the connection,and each has its own advantages and disadvantages.For the current stage where"two litigations"overlap in many aspects,rules for"before"and"during"the litigation should be added;while exploring the necessary common litigation road,we should clarify the priority of litigation and the position of authority between related institutions,clarify the priority of administrative power over judicial power in the field of ecological environmental protection,and give play to the advantageous position of environmental protection administrative organs as well as their superior resources,so as to fully and reasonably play the role of social organizations and procuratorates.In this way,we can promote the effective connection between different systems and achieve more effective ecological and environmental damage remedies.
