旅游经营者失信违法行为规制研究——基于公开的行政处罚决定书

摘　　要：旅游经营者失信违法行为成为阻碍我国旅游业高质量可持续发展的一大障碍,对旅游经营者失信违法行为进行有效治理已成为学界和业界亟待解决的重要问题。文章以中国市场监管行政处罚文书网作为数据来源库,通过构建旅游经营者失信违法行为筛查标准,对数据库中的1067份涉旅游相关行政处罚案例进行失信识别,最终定位到161份旅游失信违法行为处罚文书。通过对这些文书进行要素编码,统计其行为性质、法律依据、处罚结果,分析并呈现目前我国旅游经营者失信违法行为具有高度类型化特征且存在着法律依据散乱、处罚结果单一等问题;针对该系列问题进行原因剖析,最终从立法建设、执法协调、手段更新、自律倡导等方面提出针对性规制建议,以期促进我国旅游市场的健康可持续发展。The breach of trust and illegal behaviour of tourism operators has become a major obstacle to the high-quality and sustainable development of China s tourism industry,and the effective management of the breach of trust and illegal behavior of tourism operators has become an important issue to be solved by academia and industry.In this paper,using China Market Supervision Administrative Penalty Instruments Network as the data source database,we identify the breach of trust in 1067 tourism-related administrative penalty cases by constructing the screening criteria for breach of trust violations of tourism operators and finally locate 161 tourism breach of trust violation penalty instruments.By coding the elements of these instruments,counting the nature of their behavior,legal basis,and penalty results,the analysis presents that the current tourism operators breach of trust violations in China have highly typological characteristics and problems such as scattered legal basis and single penalty results;analyzing the causes of the series of problems,and finally putting forward targeted regulatory suggestions from the aspects of legislative construction,law enforcement coordination,means updating,and self-regulatory advocacy to promote the healthy and sustainable development of China s tourism market.
