网络服务提供者间接侵权责任的重新思考——以重大体育赛事节目版权保护为例

摘　　要：随着互联网行业的发展和技术的进步,网络侵权的规制难点从盗播者直接侵权的认定逐渐转变为网络服务提供者间接侵权的认定,“避风港原则”不再是互联网平台免责的港湾,著作权人要求重新界定和适用通知删除规则。如何界定平台的“注意义务”和“合理措施”,如何平衡著作权人、网络服务提供者和社会公众间的利益,成为学界、司法界和产业界的关注焦点。体育赛事侵权纠纷具有特殊性,综合考虑赛事节目的权属状况、赛事节目的知名度和影响力、赛事侵权预警措施的采取、互联网平台的商业模式、互联网平台对事先审查义务的自认、侵权筛查技术的发展等因素,网络服务提供者负有更高的注意义务,不能消极等待权利人的侵权通知,应采取合理措施对平台上的侵权内容进行事先筛查。With the development of the internet industry and the advancement of technology,the difficulties of regulating online infringement have gradually changed from the determination of direct infringement of the infringer to indirect infringement of by the internet service provider.and the safe harbor rule is no longer the harbor for internet platforms to be exempted from liability.The copyright owner requires redefinition and application of the notice and takedown.It has become the focus of academic,judicial and industrial circles how to define the"duty of care"and"reasonable measure"of the platform,and how to balance the interests of copyright owners,internet service providers and the public.The infringement to the sport event is very special.The internet service provider should take on more duty of care because of the ownership status of the sport event,its popularity and influence,the adoption of warning of the infringement,the business model of the internet platform,the self-recognition of the internet platform for the obligation of prior review and the development of infringement screening technology.The internet service provider can't passively wait for the infringement notice from the copyright owner,and should take reasonable measures to screen the infringing content on its platform in advance.
