摘　　要：通过对一起涉外医疗机构超出登记范围开展诊疗活动案的分析,总结在调查取证以及行政处罚裁量中的重点和难点问题,为同类案件的办理提供参考。此外,还就与案件相关的涉外医疗机构和外国医师的执业监管、专家咨询制度的运用、医疗鉴定体系的完善、法定代理人的确认等内容提出建议,以期更好维护医患双方的合法权益。In this thesis,a case of diagnosis and treatment activities conducted by a foreign-related medical institution beyond the scope of registration was analyzed.The summary of the key and difficult issues in investigation and evidence collection as well as administrative penalty was carried out.Based on this,the reference was provided for the handling similar cases.Furthermore,the suggestions on the practice supervision of foreign-related medical institutions and foreign doctors related to the case,the application of expert consultation system,the perfection of medical appraisal system,the confirmation of legal representatives and so on were proposed in this thesis,so the legitimate rights and interests of both doctors and patients can be better guaranteed.
