论政府数据开放中公民参与权的立法完善

摘　　要：政府数据开放是数字政府构建的重要基础,其完善的制度构建与高效的数据利用离不开公民的有效参与.立法实践中公民参与权的设置存在诸多问题,表现为公民参与权权利范围模糊、程序性权能单薄致使实质效能受限、权利救济不足等,其原因是权利立法层面的基础逻辑不适用、权利内容不充分及救济意识与制度的缺位.政府数据开放中公民参与权具有政治、经济与社会等多重价值,其公民视角可为当下政府数据开放提供民主的制度引导、高效的治理路径与公正的法治价值.公民参与权的落实与发展亟待更多的立法关注,我国政府数据开放制度应当构建公民参与充分的数据开放秩序与相应管理机制,在转变传统立法逻辑、细化公民参与的实体性原则与程序性规则及构建充分的救济制度上作出立法层面的完善.Open government data is a crucial foundation for the construction of digital government,and its perfect system construction and efficient data utilization cannot be separated from effective citizen participation.There are many problems in establishing the rights of citizen participation in legislation,such as the vague scope of the rights of citizen participation,the limited substantive efficiency caused by thin procedural power,the lack of right relief,and so on.The reasons for these problems are the in-applicability of basic logic at the legislative level of rights,insufficient rights content,and a lack of relief consciousness and system.The rights of citizen participation in open government data have multiple values in politics,economy,and society,and its citizen perspective can provide a democratic institutional guidance,an efficient governance path,and a fair rule of law value for current open government data.As a result,more legislative attention is required for the implementation and development of the rights of citizen participation.China’s open government data system should build an open data order and corresponding management mechanism with full citizen participation,as well as improve it at the legislative level by changing traditional legislative logic,refining substantive principles and procedural rules of citizen participation,and constructing an adequate relief system.
