公平竞争审查责任制度之重构

摘　　要：公平竞争审查制度是新时代深入推进市场化改革、优化营商环境的重大举措,但其责任制度之缺陷严重影响了该制度功能的发挥。应当以严格、完备的公平竞争审查责任制度重构为目标,首先,对该制度的构成要素及我国目前的建构状况进行考察;其次,运用比较研究方法,重视理论对立法实践的指引,充分挖掘经济法责任理论中对公平竞争审查责任制度建构具有启发意义的元素;最后,指出我国公平竞争审查责任制度重构路径:追责程度应该加重,追责主体及其承担的责任形式应更加细化和多样,责任构成要件和追责原则进行制度创新,充分重视纪检监察和公益诉讼的监督作用。The fair competition review system is a major measure to promote market-oriented reform and optimize the business environment in the New Era,but the defects regarding its accountability arrangement is seriously harming the functioning of the system.With the reconstruction of strict and complete fair competition review liability system as the goal,the paper analyzes the connotation of the system and the current situation of its construction and development in China and proves the necessity of the construction of strict and complete liability system from theoretical and practical aspects.By referring to the practical experience of strict accountability system application in typical fields and drawing resources from the research results of economic law liability system and related theories,we try to reconstruct the fair competition review liability system based on the original form of the lia-bility system,so as to improve the operation performance of the fair competition review system and solve the problems of its imple-mentation in practice.
