美欧学者视角下的习近平法治思想:认知特征与影响因素

摘　　要：美欧学者主导着海外学界关于习近平法治思想的研究,在研究成果、研究队伍和研究话语权上均有明显的体现。美欧学者的研究主要从习近平法治思想的提出背景和原因、中国推进全面依法治国战略的成效以及新时代中国法治建设的国内外影响等方面展开,具有很强的实用主义导向。总体而言,美欧学者肯定习近平法治思想提出的重大意义,认同新时代全面依法治国战略取得的成效,认为习近平法治思想将对中国和世界产生重大影响。归因于对习近平法治思想熟悉程度、研究偏好和知识结构的差异、习近平法治思想的对外传播方式以及意识形态因素的影响,美欧学者对习近平法治思想的认知仍存在一定的差异,部分美欧学者对习近平法治思想的认知偏见和悲观态度一定程度上依然存在。Xi Jinping Thought on rule of law is fundamental principles and action guidelines for comprehensive rule of law in the new era,which has aroused continued focus and studies from foreign scholars since its formation.As the dominator of China studies in foreign academics and an important actor in US and EU policy-making towards China,US and EU scholars dominate overseas studies on Xi Jinping Thought on rule of law.Currently,though there are lots of researches on Xi Jinping Thought on rule of law in Chinese academics,which are mainly conducted on formation and meaning of Xi Jinping Thought on rule of law from the angle of Chinese scholars,the related researches from international angles are scarce.Thus,the analysis on Xi Jinping Thought on rule of law from the perspective of US and EU Scholars is a starting point of this paper.By analyzing monographs,journal articles,think-tank reports as well as online comments of US and EU scholars and using many kinds of research methods such as literature review,inductive analysis,and comparative analysis and so on,the paper summarizes general features of US and EU scholars’researches on Xi Jinping Thought on rule of law at the beginning,then the stances and attitudes of US and EU scholars on Xi Jinping Thought on rule of law are analyzed,and finally the influencing factors of US and EU scholars’realization are listed.This research shows that US and EU scholars dominate overseas researches of Xi Jinping Thought on rule of law in terms of research productions,talents and discourse.As to research themes,US and EU scholars mainly focus on motivations,progress,domestic and international influences of Xi Jinping Thought on rule of law,which shows that US and EU scholars’research is pragmatism-oriented.Generally speaking,US and EU scholars confirm the significance of Xi Jinping Thought on rule of law,praising its great progress and maintaining that Xi Jinping Thought on rule of law will produce significant influences both home and abroad.However,due to the degree of familiarity
