摘　　要：基于行政权不得处分原则,国家垄断行政权的行使。但行政机关相互间存在行政管辖权的转移,包括被迫和自愿两类,都不违反行政权不得处分原则。基于自愿的行政管辖权的转移,系行政机关相互间协商一致的结果,在国外有授权和委托两类,在我国目前有委托一种。行政管辖权的委托包括层级委托和横向委托。层级委托,需要以央地事权分工为基础,有助于进一步扩大地方自主权,发扬行政民主。横向委托,有助于弥补组织法上的不足,加强协同合作。行政管辖权委托制度的建立,需要法律规定相应的范围、条件和程序。其实施将涉及财物的所有权或使用权移交。我国对行政管辖权委托存在现实需求,也有《行政许可法》和地方行政程序立法的基础,还有司法实践的经验支撑,已具备了统一立法的条件,建议在拟制定的行政程序法中作出专门规定。Based on the doctrine of No Disposition of Administrative Power,the state monopolies the exercise of the administrative power.There are two types of transferring of administrative power between administrative agencies either on a compulsory or voluntary basis,neither of which can breach the aforementioned doctrine.Voluntary transfer of administrative power is the result of consensus between administrative agencies.Empowerment and delegation are two kinds of voluntary transfer in foreign countries,but in China only exists delegation.Delegation of administrative power includes hierarchical delegation and horizontal delegation.Hierarchical delegation is based on division of au-thorities between central and local governments.It contributes to further enlargement of local autonomy and promotes administrative democracy.Horizontal delegation helps to make up deficiencies in organization laws and reinforce coor-dinated cooperation.The establishment of delegation of administrative power requires legislation to set out scope,con-ditions and procedures of delegation,and its implementation involves transfer of properties ownership or right of use.There are realistic demands for delegation of administrative power in China.Administrative License Law and local ad-ministrative procedures rules have provided basis for the delegation system,and judicial practices also have provided empirical support.Therefore,it is necessary to enact formal legislation on delegation of administrative power,which should be specially regulated in the proposed Administrative Procedures Law.
