摘 要:我国传统的体育法案起草模式是部门对口起草模式,该模式有它的优越性,即具备专业立法技术,法案针对性、可操作性强,便于执法与实施。但该模式也有一定的风险,最主要的就是“部门利益倾向”风险。为整合传统的法案起草模式的优势,又防范或降低其“部门利益倾向”风险,我国体育法案起草模式应建立如下优化措施:体育法律以及地方性法规应建立人大主导起草模式,体育行政法规以及规章应建立政府专职法制机构主导起草的模式,同时在以上模式中嵌入部门协调机制、法案的公开征求意见机制以及专家论证机制。如此实现我国体育法案起草的民主化和科学化。The traditional sports bill draftinGmodel is the counterpart of the department draftinGmodel in China,this model has its advantages,namely with professional legislative technology,The bill is highly targeted and operable to facilitate law enforcement and implementation.But the model also has some risks,the most main risk is a risk of the inclination to departmental benefit,to integrate the advantages of the traditional pattern of bill draft,and prevent or reduce the risk of inclination to departmental benefit,the sports law draftinGpattern should have such optimization measures:the sports laws and local regulations shall establish dominant draft mode of National People s Congress;The administrative regulations and rules of the sports should establish the model of draftinGled by the government s professional legal institutions,and at the same time embed the departmental coordination mechanism,the public consultation mechanism of the bill and the expert argumentation mechanism in the above model.In this way,the draft of sports act can be democratized and scientific in China.
