摘　　要：退役运动员再就业面临较大的制度瓶颈,其根源很大程度在于缺少充分说明给予退役运动员制度优待的理论根据。理论上证成特定退役运动员符合就业困难人员的劳动法地位,就找到了给予退役运动员就业优待的理论根据并成为进行相应制度设计的逻辑起点。落实新修订《体育法》第46、47条之规定,在法律上明确满足特定条件的退役运动员之就业困难人员地位,就能让这些退役运动员较为顺利地对接劳动法中明确的各种制度保障和政策优惠,并在现有制度范围内保障适格退役运动员的劳动法权益。Many retired athletes are faced with a large system bottleneck in the re-employment,the root of which is largely due to the failure to fully explain the theoretical basis of givinGretired athletes preferential treatment.Theoretically provinGthat certain retired athletes are in line with the labor law status of those who have difficulty in findinGemployment is a theoretical basis for givinGpreferential treatment to retired athletes and a logical startinGpoint for designinga correspondinGsystem.By implementinGthe provisions of Article 46 and 47 of the New Sports Law and clarifyinGthe status of retired athletes with employment difficulties who meet certain conditions,these retired athletes can connect with various system protection and policy preferences specified in the labor law more smoothly,and protect the rights and interests of qualified retired athletes under the labor law within the scope of the existinGsystem.
