摘 要:受到利益驱使、规划落后、监管不力等因素影响,深圳市场上出现了“工改商”“工改居”“商改居”等擅自改变建筑批准用途的违法行为,其在取得土地使用权之后至规划验收之前、规划验收之后至建筑投入使用前和建筑投入使用之后三个阶段中呈现不同的特点。经济利益驱使、相关规划滞后、土地批后监管链条不闭合、相关法律法规不完善是其产生的根本原因。通过分类执法、明确法律责任以及完善规划变更程序等措施将有助于解决此类问题。Driven by interests,backward planning,weak supervision and other factors,there have been il⁃legal acts of changing the approved use of buildings without authorization in the market,such as“industrial to commercial”“industrial to residential”“commercial to residential”,which present different characteris⁃tics in the three stages from the acquisition of land use right to the planning acceptance,after the planning acceptance to the building before the building is put into use and after the building is put into use.Driven by economic interests,relevant planning lags behind,the supervision chain after land approval is not closed,and relevant laws and regulations are imperfect.Measures such as classified law enforcement,clear legal responsibilities and improved planning change procedures will help to solve such problems.
