我国体育经纪行业的现实困境与优化展望

摘　　要：随着2022年我国《体育法》的修订,促进和规范职业体育发展并培育体育经纪服务业态已经被明确提出,体育经纪行业将迎来新一轮的机遇与挑战。研究以我国体育经纪行业发展所面临的现实困境为切入点,结合文献资料、从业经历和单项体育协会组织管理者的访谈,对我国目前体育经纪行业制度体系下运动员契约精神欠缺、经济利益冲突规制不足、跨国经纪业务衔接不畅、纠纷解决机制不成熟等相关问题进行探析。根据当前我国体育经纪行业所面临的现实困境,建议从完善行业内部治理、健全内外部纠纷解决机制、纾解体育经纪合同纠纷审理难点3个方面来进行优化。With the revision of China’s Sports Law in 2022,it is clearly proposed to promote and standardize the development of professional sports and cultivate sports brokerage services,and the sports agency industry will usher in a new round of opportunities and challenges.This research takes realistic predicament of sports agency industry in China as the starting point,combines literature,the experience of professional sports and interviews with the manager of individual sports organization,and analyzes the lack of athletes'contract spirit,insufficient regulation of economic conflict of interest,the poor cross-border connection of sports agency business,and the immature dispute resolution mechanism under the sports agency industry system in China.It is suggested to ameliorate the internal governance of the industry,improve the internal and external dispute resolution mechanism,and ease the legal difficulties in the trial of sports agency contract disputes.
