摘  要:教辅出版关乎教育事业的整体发展,需对其著作权侵权问题予以重视。文章通过对273份民事判决书的分析,得出教辅出版领域主要存在教辅与非教辅、教辅间侵权两种类型。该侵权的产生看似因未经授权使用导致,实际是由于教辅与教材存在必然联系或需其他作品所致。故可从根源入手,针对不同出版单位主体,通过著作权预登记制度辅助默示许可制度的构建,教育出版知识共享协议的完善,以及教辅出版过程中多元主体共治的参与,解决相应问题并推动教辅出版的健康发展。Teaching auxiliary publishing is related to the overall development of education,and it is necessary to pay attention to its copyright infringement.Based on the analysis of 273 civil law judgments,this paper concludes that there are mainly two types of infringements in the field of teaching aid publishing:teaching auxiliary and nonteaching auxiliary,and infringements between teaching auxiliary.The reason for the infringement seems to be caused by unauthorized action,but it is actually caused by the inevitable connection between the teaching aids and the teaching materials or the need to expand other works,as well as the existence of market competition.Therefore,under the environment in which publishing units are different,we should start from the root cause,assist the construction of the implied license system through the copyright pre-registration system,implement the educational publishing knowledge sharing agreement,and the participation of multiple subjects and co-governance in the process of teaching and auxiliary publishing,so as to solve the corresponding problems and promote the healthy development of teaching supplementary publishing.
