摘  要:法律教育中追求科学化和客观性的倾向给法律教育带来危害,哲学在法律教育中的作用不容无视。努斯鲍姆教授从捍卫苏格拉底并延续其追问出发,描述了法律教育中哲学能为其带来助益的几个领域。她认为法官和法律思考者应该多一些苏格拉底式的好奇,在掌握相关经验信息的情况下,对基础性议题之精微部分进行协同且严谨的探索。她认为此种思考对于人类而言具有普遍的益处。因此,她主张让法科学生学会好奇,学会进行哲学追问和哲学分析。同时,本文还讨论了法律教育中哲学探讨的限度和在具体教育活动中哲学探讨应该采取的恰当形式。The tendency of regarding law as pure science and the pursuit of objectivity in legal education might be detrimental to legal education per se.The role of philosophy in legal education should not be overlooked.With Socratic questioning and inquisition as a starting point,Prof.Nussbaum dwells on the use and abuse of philosophy in legal education,with special importance attached to the several fields in which philosophy could be of important help.She holds that judges and law students should indulge in the Socratic curiosity and exploration.With the relevant information and data as a basis,judges and law students should perform concerted and serious exploration in the realm of basic research topics.This way of exploration can be of benefit to human beings as a whole.In this sense,law students should learn to be curious and acquaint themselves with philosophical inquisition and analysis.Meanwhile,efforts have also been made in this paper to discuss the limits of the use of philosophy in legal education and the proper forms of it.
