债权文书强制执行公证之效力

摘  要:经过公证的赋予强制执行效力的债权文书可以不经诉讼程序直接申请予以强制执行,其法律依据是《中华人民共和国民事诉讼法》《中华人民共和国公证法》。其法理基础有两方面:一是债务人自愿接受强制执行的承诺;二是节约司法资源,降低社会成本。在办理房地产抵押合同强制执行公证时,必须要求当户和典当行先到当地房地产管理部门办理抵押登记手续,方可办理房地产抵押合同强制执行公证;最高额的抵押合同一般不易赋予强制执行效力。A notarized creditor’s right document with the effect of compulsory execution can be directly applied for compulsory execution without litigation procedure,and its legal basis is the Civil Procedure Law of the People’s Republic of China and the Notarization Law of the People’s Republic of China.Its legal basis has two aspects:First,the debtor voluntarily accepts the commitment for enforcement;Second,to save judicial resources and reduce social costs.When dealing with estate guaranty contract to carry out notarization compulsively,we must ask the pawnbroker and the pawnshop to go through the mortgage registration formalities with the local real estate management department before they can notarize the compulsory execution of the real estate mortgage contract,and the maximum mortgage contract should not be given compulsory execution effect.
