摘  要:儿童是缺乏完全行为能力而需要外力扶助的群体,儿童福利是需要外在支持才能实现的“积极权利”,儿童福利权利的实现需要国家与社会投入资源。目前我国儿童福利建设实践中运行的多元参与机制,存在着主体责任游离问题,难以保障儿童福利权利的充分实现。党的二十大报告不仅提出“以人民为中心的发展思想”,明确了我国今后新的历史阶段以儿童为中心的儿童福利建设的取向,更提出“全面发展协商民主,推进协商民主广泛多层制度化发展”,为儿童福利权利实现机制的改进指出了路径,即由多元参与转向公共协商。而这需要构建公共协商的积极主体,建立常态化公共协商平台,构建公共协商规则,为儿童福利权利实现机制的重构提供组织与制度保障.Children are a group lacking full behavioral capacity and in need of external assistance.Children's welfare is a"positive right"that can only be realized with external support.The realization of children's welfare rights requires the input of resources from the state and society.At present,the"multiple participation"mechanism in the practice of child welfare construction in our country suffers from the problem of responsibility dissociation,which is difficult to ensure the realization of children's welfare rights.The report of the Party's Twenty National Congress not only put forward"people-centered development thought",but also clarified the orientation of child-centered welfare construction in the new historical stage in the future.Moreover,it proposes to"comprehensively develop consultative democracy and promote the extensive and multi-tiered institutionalized development of consultative democracy",and points out the path for the improvement of the realization mechanism of children's welfare rights,that is,from"multiple participation"to"public consultation".This requires the construction of active subjects of public consultation,the establishment of a normal public consultation platform,the construction of public consultation rules,and providing organizational and institutional guarantee for the reconstruction of the realization mechanism of children's welfare rights.
