摘 要:营商环境的持续优化离不开现代化的市场监管体系作为基础和支撑。对近年来的监管改革进行经验总结和理论建构,在承先启后的基础上,将有助于积极稳妥地开展未来监管改革的谋篇布局。本文指出,市场监管是对市场主体和消费者进行的产权保护;产权保护分别由政府和市场主体作为主要行动者展开,通过在政府内部落实市场主体产权保护责任以及在政府与市场间分配消费者产权保护责任的制度结构,优化监管改革。未来市场监管改革需发挥政府在市场主体产权保护中的能力优势和在消费者产权保护中的间接作用,理顺监管主体多元化条件下有效市场和有为政府的边界。The continued optimization of business environment requires the support of a modernizd market regulation system.Summarization and theorization of previous reforms will contribute to the steady progress of future reforms.This article argues that the aim of market regulation is to protect the property rights of market entities and consumers,and its institutional efficiency rests on government assuming the responsibility of protecting market entities and market entities taking the responsibility of consumers protection.Regulation reforms so far have improved the contract structure inside government agencies in protecting property rights of market entities,as well as the contract structure between government and market entities in allocating responsibility of consumer protection.Future regulatory reform should enhance the role of government in protecting property rights of market entities,and indirect role of government in protecting property rights of consumers.This article offers a new explanation of regulatory reforms in China based on contract and property rights theory.
