摘　　要：20世纪80年代,政府购买服务在西方国家逐渐发展起来,合同管理是其主要方式,如何创新合同管理也成为近三十年来政府购买服务研究的核心议题。在政府购买复杂性社会服务时,合同管理面临着直接挑战。对此,合同治理被提出并在四个维度上与合同管理突显出差异。合同治理将“先约定—后执行”转变为“在执行中约定”和“在约定中执行”,运用正式规则与非正式关系形成治理结构,以规则重构和信任提升形成“双轮驱动”和“双向赋权”,推动合同治理结构化,在提高服务效果的同时增强服务供给主体能力,从而促进效能的全面提升。In the 1980s,the government purchase of services gradually developed in Western countries.In this period,contract management is the main way,and how to innovate contract management has become the core topic of the research on government purchase services in the last thirty years.Contract management faces immediate challenges when governments purchase complex social services.In this regard,contract governance is proposed and differs from contract management in four dimensions.Contract governance translates"planning first-implementing last"into"planning by implementing"and"implementing by planning".Also,contract governance uses formal rules and informal relationships to form a governance structure,and uses rule reconstruction and trust enhancement to form"two-wheel drive"and"two-way empowerment".In this way,contract governance structure has been taken in form,which can enhance the main bodies'ability of service supplying while improving the service effect,so as to promote the overall improvement of efficacy.
