摘　　要：法律离不开其背后的语境世界。传统经济法理论是市场经济高度发达的产物,虽然数字化、智能化会深刻地改变市场经济的要素,但数字经济不是相对市场经济而言的,而是相对工业经济而言的。数字化、智能化背景下传统经济法的问题非但没有消失,反而以一种更复杂、更隐蔽的形态存在,防止人的边缘化与重拾人的主体地位仍旧是经济法的核心命题。数字化、智能化催生了平台和人工智能主体两类新主体,为回应新主体以及新的主体间关系招致的新问题,市场、社会和国家三个层面的经济法主体也将随之联动。Law cannot be separated from the contextual world behind it.The theory of traditional economic law is based on the highly developed market economy.Although digitalization and intellectualization will profoundly change the elements of market economy,digital economy is not relative to market economy,but relative to industrial economy.Under the background of digitalization and intellectualization,the problem of traditional economic law has not disappeared,but exists in a more complex and hidden form.Preventing people from marginalization and regaining their dominant position is still the core proposition of economic law.Digitization and intellectualization have given birth to two types of new subjects:platform and artificial intelligence.In response to the new subjects and the new problems caused by the relationship between the new subjects,the subjects of economic law at the three levels of market,society and the state will also be linked.
